Our aggregate liability for any claims arising from our services shall be limited to the total amount paid by you to Mosaic in the twelve months preceding the claim, or $500 USD, whichever is greater.
These limitations apply regardless of the legal theory on which the claim is based, whether contract, tort, negligence, strict liability, or otherwise, and even if we have been advised of the possibility of such damages.
6. Indemnification
You agree to indemnify, defend, and hold harmless Mosaic, its affiliates, officers, directors, employees, consultants, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

- Your violation of these Terms and Conditions
- Your violation of any rights of another party, including intellectual property rights
- Your violation of any applicable laws or regulations

- Your negligence or willful misconduct

Both parties agree to:

8. Dispute Resolution
In the event of any dispute, controversy, or claim arising out of or relating to these Terms and Conditions or our services, the parties agree to:
- First attempt to resolve the matter through good-faith negotiations
- Engage in mediation if negotiations are unsuccessful
- Submit to the jurisdiction of courts in Istanbul, Turkey if mediation fails
Nothing in this section prevents either party from seeking injunctive relief or other equitable remedies to protect intellectual property rights or confidential information.
9. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions.
You agree to submit to the exclusive jurisdiction of the courts located in Istanbul, Turkey for the resolution of any disputes. However, we retain the right to bring legal proceedings in any jurisdiction where you reside or conduct business.
10. Force Majeure
Neither party shall be liable for any failure or delay in performance under these terms due to circumstances beyond their reasonable control, including but not limited to:
- Acts of God, natural disasters, or extreme weather conditions
- War, terrorism, civil unrest, or government actions
- Pandemics, epidemics, or public health emergencies
- Strikes, labor disputes, or supply chain disruptions
- Internet or utility failures beyond our control
- Any other events that cannot reasonably be anticipated or controlled
11. Severability
If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable. If modification is not possible, the provision shall be severed from these terms. The remaining provisions shall continue in full force and effect.
12. Entire Agreement
These Terms and Conditions, together with our Privacy Policy and any specific service agreements, constitute the entire agreement between you and Mosaic regarding your use of our website and services.
